"AMUL STAR VOICE OF INDIA CONTEST" RULES AND REGULATIONS

"Amul Star Voice of India Contest" ("Contest") will be held all across India at the retails outlets/ice cream parlours where Amul ice-cream cones are sold ("Location"). The Contest will be in relation to the program titled "Amul Star Voice of India - 2" ("Program") as stated hereunder:

1. The Contest will be open from September 5, 2008 at 9:00:00 hours to October 10, 2008 till 23:59:59 hours ("Period") (both dates inclusive).

2. Amul has printed the faces and codes of the participant(s) of the Program ("Finalists") on Amul ice-cream cones ("Amul Cone(s)").

3. The participant(s) who is interested in participating and qualifying for the Contest should buy an Amul Cone(s) from the Location and send an SMS to 57827. The SMS should contain the keyword ASVOI followed by followed by the code of the Finalist printed on the Amul Cone(s).

4. The entries should be sent by the participant(s) during the Period of the Contest stating all the required information, which have been asked from them. Entries sent after the Period stated in this rules and regulations shall not be considered and shall be invalid.

5. The participant(s) who are subscribers of (i) Vodafone or (ii) Idea or (iii) Reliance Communications or (iv) BSNL or (v) MTNL Delhi (prepaid/postpaid) or (vi) MTNL Mumbai (postpaid) or (vii) BPL or (viii) Spice Telecom or (ix) Tata Indicom or (x) Airtel or (xi) Aircel or (xii) Reliance Telecom shall be able to participate in the Contest.

6. The cost of the SMS shall be solely borne by the participant(s). The cost of each SMS shall be charged by the respective mobile operators at rate stated herein below:

Cost: Rs. 3: Vodafone, Airtel, BPL, Idea, Reliance Communications, Spice Telecom, Aircel, Reliance Telecom and Tata Indicom

Rs. 2: MTNL Delhi (Pre paid), BSNL

Rs. 1: MTNL Mumbai, MTNL Delhi (post paid).

STAR India Private Limited ("STAR India") shall not be responsible in the event of any network problem and/or the cost of the SMS charged by the mobile operator. Any dispute in connection to the same shall be settled between the subscriber and the mobile operator directly and without involving STAR India.

7. STAR India shall not be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the network operator. Any dispute in connection to the same shall be settled between the participant(s) and the network operator without involving STAR India.

8. In case of telecom and/or network failure and/or for any other reason whatsoever, STAR India reserves the right to change the voting system/mechanism or take such necessary steps as it may deem fit.

9. STAR India shall randomly select seventy three (73) winner(s) from the participant(s) who STAR India believes have sent a complete SMS (containing the code and other relevant details asked) ("Winner(s)"). STAR India shall solely have the right to select the Winner(s) and none of the participant(s) shall be entitled to dispute the decision made by STAR India.

10. There will be seventy (73) Winner(s) selected by STAR India out of which:


10.1 Three (3) Winner(s) will get a chance to attend the grand finale of the Program. Out of the three (3) Winner(s), if any/all of them are residing outside Mumbai, then arrangements will be made only for those Winner(s) to stay in a three (3) star hotel for one (1) day i.e., the day of grand finale. All expenses pertaining to the same shall be borne by STAR India.

10.2 Twenty (20) Winner(s) will win a cordless ear phone of Amul Star Voice of India -2 and:

10.3 the remaining fifty (50) Winner(s) will win goody bags of Amul Star Voice of India - 2. ("Prize").

All the Winner(s) of the Contest for the abovementioned Prizes will be selected randomly by STAR India.

11. If the Winner(s) as stated in rule 10.1 above reside outside Mumbai, then the Winner(s) shall be solely responsible to make his/her own arrangements to reach Mumbai to attend the grand finale and consequently make their own arrangements to return from Mumbai to the place they reside. All the costs, charges and expenses in connection to the same shall be borne solely borne by the Winner(s).

12. The Winner(s) will also be provided breakfast, lunch and dinner during their stay in Mumbai. The hotel would be chosen by STAR India and the decision of STAR India in this regard shall be final and binding.

13. The Winner(s) shall be informed/contacted by STAR India.

14. In the event, the Winner(s) fail to be present on the day of grand finale of the Program on the date on which STAR India has decided for the grand finale of the Program, STAR India shall be entitled to forfeit the Prize and/or announce somebody else as the Winner (s) of the Contest.

15. Save and except as stated in rule 11 and rule 12 herein above, all and any incidental costs (direct and/or indirect), in relation to the Prize, including but not limited to any STD/ISD/local calls and/or any other services used by the Winner(s) (as the case may be) in the hotel in Mumbai, shall be borne by the Winner(s) and in no manner whatsoever shall the STAR India be held responsible for the same.

16. The Winner(s) shall not be allowed to stay longer in the hotel beyond the stay granted as the Prize. In the event, the Winner(s) decides to deviate from the Prize; the Winner(s) would have to bear all such costs, charges, risks and expenses in connection thereof.

17. Neither STAR India nor its employees have given a guarantee and/or warranty etc. regarding the services to be offered by the hotels etc. and neither STAR India nor its employees shall be responsible for any reason whatsoever in connection thereto.

18. The Winner(s) of the Contest shall not raise any dispute with regard to the Contest including but not limited to the selection of the Winner(s) etc.

19. STAR India reserve the right to at any time to withdraw the Contest without giving any prior notice thereof.

21. Winner(s) shall be solely responsible for the safety of them during the stay in Mumbai and travel to/from Mumbai and shall at all time keep STAR India indemnified in connection thereto.

22. Star India shall not be responsible in case of shortage of Amul Cone(s) at the Location.

General Rules

1. The participant(s) should be citizens of India, residing in India and above 18 years of age to qualify for the Contest.

2. The participant(s) should not have criminal conviction or an arrangement or a contract that prevents the participant(s) from participating in the Contest.

3. Proof of age is a must for the participant(s), ) and should be submitted to STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

4. STAR India reserve all rights to make amendments to the existing rules without prior notice.

5. Non-conformance by any participant(s) and/or the Winner(s) of these rules of the Contest will disqualify the participant(s) or the Winner(s) from participation or winnings, immediately, as the case may be.

6. STAR India may in its sole discretion exclude a participant(s) from participation in the Contest which may include without limitation (i) circumstances which, in STAR India's view, renders the participant(s) unfit to participate therein; (ii) inability to produce documentation required by STAR India at any given point of the time.

7. STAR India reserves the right to cancel the entry of the participant(s) for any reason whatsoever. For avoidance of doubt, the disqualified participant(s) agrees that all the intellectual property rights in and to the Contest shall continue to vest with STAR India for worldwide and in perpetuity, without any consideration payable to the disqualified participant(s).

8. STAR India may refuse the participant(s) from participating in the Contest in the event of his/her fraud, dishonesty or non-entitlement to participate in the Contest under this rules and regulations.

9. All participant(s), the Winner(s), of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with STAR India and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Winner(s). Further, neither the participant(s) nor the Winners shall at any point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Winner(s) agree that the footage of any nature with regard to the Winner(s) shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

10. The Winner(s) shall be responsible to collect the Prize from STAR India within ninety (90) days. The Winner(s) agree that the Prize cannot be exchanged with other items and/or exchanged for cash equivalent. The Winner(s) further agree that he/she shall not dispute the value, quality and content of the Prize so offered to the Winner(s) upon the Winner(s) winning the Contest. If the Winner(s) refuse to accept the Prize offered, STAR India shall be released from all obligations towards the Winner(s) in connection to the Prize won by the Winner(s).

11. STAR India shall have irrevocable rights to the Contest and/or participation of the participant(s) including all the activities of the participant(s) during their participation in the Contest including but not limited to the Winner(s) visit to the sets etc., being filmed and/or recorded and/or broadcast on any of Star India's channels and/or any other channel, which STAR India may deem fit. Further, the participant(s) shall permit STAR India to use of the participant(s)'s name, likeness and private life to be included in the subject matter of the Contest and any related publicity, advertising, magazine material and/or otherwise. Further STAR India shall have full right to the footage of any nature in relation to this Contest and all such rights shall at all times vest with STAR India, including but not limited to all intellectual property rights, copyrights and any other rights, in any and all media, worldwide and in perpetuity. It can be arranged, re-arranged, added to other material without any payments to the participant(s).

12. Notwithstanding a participant(s) participation in the Contest there is no obligation on the part of STAR India to broadcast the Contest in which he/she has taken part, or any or all of his / her contribution as recorded by STAR India.

13. The participant(s) of the Contest and the Winner(s) agrees that he/she shall hold harmless STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the STAR India to claim any damages or relief's or otherwise.

14. The Winner(s) agree that if due to any reason, whatsoever, beyond the control of STAR India, the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, then STAR India shall not be responsible for the same.

16. STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Winner(s) or any person in connection to them in any manner whatsoever, including but not limited to the Contest and/or Prize.

17. Employees of STAR India and/or its group companies, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to enter the Contest.

18. Any and all taxes and/or levies applicable under the laws of India shall be borne by the Winner(s) of the Contest in relation to the Prize. A copy of the receipt (challan) confirming the payment of such taxes, charges, license fees and/or levies thereto shall be furnished by the Winner(s) to Star India. Star India shall not be responsible for the same.


19. The participant(s) including the Winner(s) shall abide to the laws of India including Income Tax Act, 1961. STAR India will not be liable for non-compliance of any laws by the Winner(s) in India and the Winner(s) shall indemnify and hold harmless STAR India in relation thereto.

20. Participation of the participant(s) in the Contest shall be construed that the participant(s) has waived their rights to dispute any decision(s) made by STAR India in connection to the Contest and that the participant(s) agrees to all the decision(s) made by STAR India and that all such decision shall be final and binding upon the participant(s). No correspondence in this regard shall be entertained.

21. The participation of the participant(s) in the Contest shall mean that the participant(s) has read, understood, accepted and agreed to abide with all the rules including the general rules of the Contest.

22. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the natural and/or the legal guardian of the participant(s) who has raised the dispute.
